Protection of Intellectual Property Rights (IPR)

The posting of counterfeits, replicas, or any unauthorized items is strictly prohibited on the Site. Any postings facilitating the sale or purchase of such items will be subject to removal by Global Trade Nest. The following list outlines the products/types that are restricted on Global Trade Nest:

Repeat Infringement Consequences

Repeated infringement of our IPR policy may result in various actions, including but not limited to:

  • Removal of postings
  • Posting limitations
  • Account suspension
  • Termination of the registration service agreement

Global Trade Nest retains the discretion to take enforcement action at any time, especially in exceptional or prominent circumstances where intellectual property rights holder litigation is ongoing.

Infringement Claims

All intellectual property infringement claims will be made under the penalty of perjury. Intellectual property right holders agree to indemnify and hold Global Trade Nest harmless from all claims, causes of action, damages, and judgments arising from any removal of product listings under intellectual property infringement claims. As an unbiased e-commerce platform, Global Trade Nest does not assert conflicting intellectual property infringement claims. Any action taken by Global Trade Nest will not be construed as an endorsement of any intellectual property infringement claim. All conflicting intellectual property infringement claims will be resolved independently by the relevant conflicting parties, separate from Global Trade Nest and the Site.

IPP (IP Protection Platform), the online report system

IPP offers an efficient and transparent channel for intellectual property rights holders to file intellectual property infringement claims and request the takedown of allegedly infringing listings from the Site. Three types of materials must be submitted to IPP to facilitate processing of intellectual property infringement claims: Proof of identity of the complaining party and relevant authorization if the complaining party is not the intellectual property right holder. Evidence of intellectual property ownership. Specific and interactive hyperlinks of the allegedly infringing listings on the Site. Global Trade Nest will promptly evaluate intellectual property infringement claims filed via IPP. Individuals subject to intellectual property infringement claims will be informed of the claims, and the contact information of the intellectual property rights holders will be provided to facilitate direct resolution and claim handling. Individuals subject to intellectual property infringement claims may submit counter-notifications to dispute the corresponding claims. Intellectual property rights holders will be notified if and when any counter-notifications are filed and may accept or reject such counter-notices. Global Trade Nest reserves the right to reinstate any posting subject to intellectual property infringement claims at our discretion.
